Regulations for the Patient

§ 1
[Postanowienia ogólne]

1. These Regulations (hereinafter: "Regulations") are addressed to patients (hereinafter: "Patient") receiving psychotherapy and other services provided by Valor sp. z o.o. (Mente - Holistic Therapy and Support Center in Krakow) (hereinafter: "Mente").
2. By registering to attend a psychotherapy/psychological therapy session (or a session for other services such as physiotherapy or acupuncture) provided by Mente (hereinafter: "Session"), the patient accepts the terms and conditions described in these Regulations.
3. Podstawowymi zadaniami realizowanymi w Mente są diagnostyka psychologiczna, interwencja kryzysowa, poradnictwo psychologiczne, psychoterapia, przeprowadzanie szkoleń, psychoterapia grupowa, a także organizacja warsztatów, akupunktura, terapia
   integracji strukturalnej, osteopatia.
4. As a rule, a Patient is an adult natural person (as well as a person with full legal capacity) using the services provided by Mente. If a minor without full legal capacity were to become a Patient, his/her participation in the Session must be consented to by a legal guardian, such as a parent with full custody.

§2

1. Registration for a Session is made by the Patient through the reservation system available on the website https://centrummente.pl/ (hereinafter: "Website") or by phone, calling +48 577 707 663.
2. Booking a Session date requires the Patient to provide the necessary data, such as name, phone number and e-mail address. The Patient has the opportunity to indicate, if available, a specific Specialist and the date of the Session.
3. Dokonanie rezerwacji terminu Sesji oraz potwierdzenie terminu przez Mente (poprzez wysłanie wiadomości na adres e-mail podany przez Pacjenta) oznacza zawarcie umowy na świadczenie usług psychoterapeutycznych/terapii psychologicznej (lub innych usług,
   w zależności od wybranej przez Pacjenta opcji).
4. Once a Session date is booked and the date is confirmed by Mente, the Patient has 48 hours to pay in accordance with the price list found on the Website.
5. The payment is made through a third-party payment platform Tpay. Details and payment regulations are available on the website of the payment processor at https://tpay.com/user/assets/files_for_download/regulamin.pdf.
6. In the case of booking more than one Session, each of the subsequent Sessions (except the one with the closest date), should be paid no later than 48 hours before the date of the Session.
7. The date of payment of the fee is considered to be the moment when the payment is credited to Mente's bank account.
8. If payment for a particular Session is not made by the agreed date, Mente reserves the right to cancel the Session.

§3
[sesje]

1. As a rule, a psychotherapy session lasts 50 minutes. The length of Sessions for other services may vary, depending on the specific service and arrangements with the Specialist.
2. If the Patient is late, it is not possible to extend the Session (except in exceptional cases and a slight extension of the Session).
3. Sessions are conducted from 8:00 a.m. to 8:00 p.m. In exceptional circumstances, it is possible to hold Sessions at other times.
4. Sessions take place, unless otherwise agreed with the Patient, at the premises of Mente in Krakow, Dietla Street 50/8. Sessions may also be conducted remotely - online, in accordance with the rules indicated in §4 of the Regulations.
5. The frequencý of sessions and the total duration of cooperation are discussed individually with the patient.
6. If in fortuitous circumstances, e.g. due to illness of the Specialist, it is necessary to cancel the Session, Mente will communicate this information to the Patient in order to set a new Session Date or refund the fee (if the Patient does not agree to the proposed date).
7. All information obtained by the Specialist from the Patient during the session is covered by professional confidentiality. If the Specialist determines that the Patient requires assistance of another kind, he or she may recommend that the Patient consult another specialist, and in a health or life-threatening situation, the Specialist may himself or herself contact a specific specialist or institution.

§4
[sesja zdalna]

1. In the case of a Remote Session, the Patient agrees to use computer/phone equipment that provides Internet access (with a sufficiently fast connection to participate in the Session) along with a microphone and camera.
2. The remote session is conducted using a tool that has been agreed with the Specialist.
3. The patient agrees not to record the Remote Session without obtaining Mente's consent.
4. Patient agrees not to send/provide content of an unlawful or offensive nature in the Remote Session.
5. Mente nie ponosi odpowiedzialności za problemy techniczne, które nastąpiły po stronie
   Pacjenta.

§5
[prawo do odstąpienia i rezygnacja z sesji]

1. W każdym przypadku Pacjent ma możliwość odstąpienia od umowy na świadczenie usług Mente (w przypadku umowy zawartej poza lokalem przedsiębiorstwa albo na odległość) w ciągu 14 od jej zawarcia (z zastrzeżeniem zasad wskazanych w niniejszym
   paragrafie) bez podania przyczyny. Prawo to wykonuje się poprzez złożenie stosownego oświadczenia na adres e-mail Mente: witaj@centrummente.pl lub wysyłając wiadomości SMS pod numer 577 707 663 w terminie 14 (czternastu) dni od dnia zawarcia umowy, przy czym dla zachowania terminu wystarczające jest wysłanie oświadczenia o odstąpieniu przed upływem tego terminu. Jeżeli Pacjent zapisał się już na kolejne Sesje, może w takiej sytuacji wyrazić zgodę na zaliczenie dokonanej już płatności na poczet kolejnej Sesji (zamiast zwrotu).
2. The Patient may also cancel participation in a given Session (also after the deadline referred to in paragraph 1), with the obligation to inform Mente no later than 48 hours before the scheduled date of the Session. Cancellation of a given Session can be done by sending an email to: witaj@centrummente.pl or by sending SMS messages to 577 707 663. In case Mente is not informed about cancellation of participation in a given Session, the Patient will not be entitled to a refund of the Session fee. If the Patient has already signed up for subsequent Sessions, Mente may in such credit the payment already made to the next Session.
3. If the Patient does not show up for the next 2 scheduled Sessions and does not explain his/her absence within 3 days of the second missed Session, this means cancellation of the remaining Sessions. The remaining dates of the pre-booked Sessions will be canceled.
4. Zgodnie z art. 38 ust. 1 pkt 1 Ustawy o prawach konsumenta, prawo do odstąpienia od umowy nie przysługuje konsumentowi w odniesieniu do umów o świadczenie usług, za które konsument jest zobowiązany do zapłaty ceny, jeżeli przedsiębiorca wykonał w
   pełni usługę za wyraźną i uprzednią zgodą konsumenta, który został poinformowany przed rozpoczęciem świadczenia, że po spełnieniu świadczenia przez przedsiębiorcę utraci prawo odstąpienia od umowy, i przyjął to do wiadomości. W związku z tym, w przypadku Sesji, które odbywają się przed upływem terminu 14 dni na odstąpienie od umowy, odstąpienie nie będzie możliwe po przeprowadzeniu danej Sesji. Pacjent wyraża zgodę w takiej sytuacji na rozpoczęcie świadczenia usługi (odbycie się Sesji) przed upływem terminu na odstąpienie od umowy i oświadcza o przyjęciu do wiadomości, że odstąpienie nie będzie możliwe.
5. Jeżeli świadczenie usługi (Sesja) zostało rozpoczęte przed upływem terminu na odstąpienie, a następnie Pacjent będący konsumentem odstąpił od umowy, ma on obowiązek zapłaty za świadczenia spełnione do chwili odstąpienia. Kwotę zapłaty
   oblicza się proporcjonalnie do zakresu spełnionego świadczenia, z uwzględnieniem uzgodnionego kosztu Sesji.
6. In the case of an effective declaration of withdrawal from the Agreement by a Patient who is a consumer, Mente shall immediately, but no later than 14 days from the date of receipt of the declaration of withdrawal from the Agreement, refund to the Patient the fee paid by him/her.
7. Mente shall reimburse the fee using the same method of payment used by the Patient, unless the Patient has expressly agreed to a different method of reimbursement that involves no cost to the Patient

§6
[dodatkowe postanowienia]

1. If the Specialist wishes to record the Session (audio), the prior written consent of the Patient is required. The Patient is not obliged to give such consent (and this consent can be withdrawn at any time), with the Specialist having the right to supervise his case (analyze the course of therapy with the supervisor - while keeping the Patient's data anonymous) in any case.
2. The patient may give consent for his case to be consulted by other specialists working with Mente, including physiotherapists or psychiatrists. This consent can be withdrawn at any time.
3. Detailed information regarding Mente 's processing of the Patient's personal data can be found in the Privacy Policy provided to the Patient. The Privacy Policy can be found at the following address: www.centrummente.pl.
4. Medical records pertaining to the Patient are prepared according to the principle of minimum content and are made available for personal inspection at the Patient's exceptional request within 2 weeks of the request for inspection. The records are not made available to third parties.
5. Certificates on the use of psychological assistance are issued at the request of the Patient if at least 3 Sessions have been conducted.
6. The specialist may contact the patient to verify satisfaction in connection with the services provided (e.g., by filling out a form).

§7
[zmiany Regulaminu]

1. Mente is authorized to amend these Terms and Conditions for reasons such as a change in the law or a change in the terms of service of the Session.
2. Amendments to the Regulations shall become effective on the date indicated by Mente - which in each case shall not be less than 14 days from the date the new Regulations are made available.
3. Each Patient will be informed of the changes to the Regulations. Changes to the Terms and Conditions are binding on you if you have not terminated your contract for services within 14 days of being notified of the changes by informing Mente.

§8
[polubowne rozwiązywanie sporów]

1. Mente declares that it will endeavor, to the extent possible, to resolve amicably any disputes arising from the provision of Remote Sessions services.
2. An ODR platform, established pursuant to Regulation (EU) No. 524/2013 of the European Parliament and of the Council of 2013 on online dispute resolution for consumer disputes and amending Regulation (EC) No. 2006/2004 and Directive 2009/22/EC (Regulation on ODR in consumer disputes), is available at http://ec.europa.eu/consumers/odr. The ODR platform provides an access point for consumers and businesses to settle disputes covered by the above-mentioned regulation out of court.
3. In the event of a dispute between the Patient and Mente regarding a complaint submitted by the Patient regarding a Remote Session, the Patient, who is a consumer, may use out-of-court means of handling complaints and claims. In particular, the Patient may file a request for mediation or consideration of the case by an arbitration court, or use the assistance of a district (city) consumer ombudsman.
4. Szczegółowe informacje dotyczące możliwości skorzystania przez Konsumenta z pozasądowych sposobów rozpatrywania reklamacji i dochodzenia roszczeń dostępne są m.in. na stronie internetowej Urzędu Ochrony Konkurencji i Konsumentów
   www.uokik.gov.pl, a także na stronach internetowych Wojewódzkich Inspektoratów Inspekcji Handlowych.

§9
[postanowienia końcowe]

1. These regulations are available on the Website.
2. To the extent not covered by the Regulations, the relevant provisions of Polish law shall apply, in particular the provisions of the Civil Code and the Consumer Rights Act.
3. Signing up for a Session implies acceptance of these Terms and Conditions, which are delivered to the Patient by email or in person, at the Mente headquarters (in Krakow, Dietla Street 50/8).
4. The regulations come into effect on October 30, 2024.
